Certificate of Free Sale

A Certificate of Free Sale (CFS) is a document that acts as proof that the goods you are exporting are legally sold and distributed in the open market of the United States. It essentially tells the foreign government: “This product is not banned or restricted in the USA; it is good enough for Americans, so it should be safe for your citizens, too.”

 

Why is it needed for Machinery?

 

Historically, this certificate was used for food, cosmetics, and medical devices. However, recently, bureaucratic requirements in certain developing nations (especially in Latin America and Southeast Asia) have expanded. You might be asked for a CFS for:

  • Lubricants and chemicals: Hydraulic fluids, greases, and cleaning solvents packed with the machinery.
  • Safety gear: Helmets, harnesses, or breathing apparatus included in the shipment.
  • Re-manufactured parts: To prove that refurbished engines or transmissions are legitimate commercial products and not just scrap metal being dumped.

 

Who Issues It?

 

For heavy equipment and general industrial goods, the FDA does not issue these. Instead, you typically obtain a Certificate of Free Sale from a Chamber of Commerce or a specialized trade association. The Chamber will review your invoices or affidavits showing that you have U.S. customers buying these exact products. They then issue the certificate, which often needs to be apostilled (legalized) by the Secretary of State to be recognized by the foreign government.

 

The Registration Hurdle

 

In many countries, a local distributor cannot even list your product in their catalog or bid on government contracts until they register your brand with their local ministry. The Certificate of Free Sale is almost always the first document required for this registration. It proves you are a real, active business in your home country.

If your distributor in Colombia is asking for this, they are likely trying to register your brand to become an authorized importer.
